Welcome to Datings-Online. These Terms and Conditions ("Terms") govern your access to and use of the Datings-Online website, mobile applications, and all related services (collectively, the "Platform") operated by Datings-Online LLC ("Company," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms in their entirety. If you do not agree with any provision herein, you must discontinue use of the Platform immediately.

1. Acceptance of Terms

By creating an account, accessing any page, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. We reserve the right to modify these Terms at any time. Continued use of the Platform following any such modification constitutes your acceptance of the revised Terms. We will notify registered members of material changes via email or in-platform notification at least 14 days before they take effect.

2. Eligibility Requirements

You must meet all of the following criteria to use Datings-Online:

• You must be at least 18 years of age. The Platform is designed exclusively for adults. By registering, you represent and warrant that you are 18 or older. Any user found to be under 18 will have their account immediately terminated without notice.
• You must be legally permitted to use online dating services under the laws of your jurisdiction.
• You must not have been previously banned or removed from the Platform for violations of these Terms.
• You must reside in, or access the Platform from, the United States or a jurisdiction where the use of such services is lawful.

3. Account Responsibilities

When you create an account on Datings-Online, you agree to the following obligations:

• Accurate information: All profile information, including photographs, age, and personal descriptions, must be truthful and represent you personally. Misrepresentation may result in immediate account termination.
• Password security: You are solely responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized access to your account.
• Single account policy: Each individual may maintain only one active account. Duplicate or secondary accounts will be removed without notice.
• Profile content: You retain ownership of content you upload but grant Datings-Online a non-exclusive, royalty-free, worldwide license to display, distribute, and promote such content within the Platform for the purpose of operating the service.

4. Prohibited Conduct

The following activities are strictly prohibited on the Platform. Violations may result in immediate account suspension or permanent termination:

1. Harassment or abuse: Engaging in threatening, intimidating, or abusive behavior toward any member, including unsolicited explicit content or persistent unwanted contact after being blocked.
2. Fake profiles and impersonation: Creating profiles using false identities, stock photos, or another person's likeness. Our verification system is designed to detect and remove such accounts.
3. Commercial solicitation: Using the Platform to advertise products, services, or third-party websites, or to solicit money from other members under any pretense.
4. Illegal activity: Using the Platform to facilitate any activity that violates local, state, federal, or international law, including but not limited to prostitution, trafficking, or distribution of illegal substances.
5. Hate speech and discrimination: Posting or transmitting content that promotes hatred, violence, or discrimination based on race, ethnicity, gender identity, sexual orientation, religion, or disability.
6. Data scraping and automation: Using bots, crawlers, or automated tools to extract member data, send bulk messages, or interact with the Platform in any non-human manner.
7. Malware distribution: Uploading or transmitting viruses, spyware, or any malicious code through the Platform.

5. Intellectual Property

All content, design elements, trademarks, logos, software, and proprietary technology associated with the Platform - including the Datings-Online name, gold verified badge system, and matching algorithms - are the exclusive property of Datings-Online LLC and are protected under United States copyright, trademark, and intellectual property laws. No portion of the Platform may be reproduced, distributed, modified, or reverse-engineered without our prior written consent.

User-generated content remains the property of the user who created it. By posting content on the Platform, you grant us a limited license to use, display, and distribute that content solely for the operation and promotion of the service. This license terminates when you delete your content or your account, except where copies have been shared with other users through normal Platform functions.

6. Limitation of Liability

The Platform is provided on an "as-is" and "as-available" basis. Datings-Online LLC makes no warranties, express or implied, regarding the reliability, accuracy, or availability of the service. We do not guarantee that the Platform will be uninterrupted, error-free, or secure at all times.

To the maximum extent permitted by applicable law, Datings-Online LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to damages for loss of data, emotional distress, or personal injury resulting from interactions with other members. Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

7. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice, if we reasonably believe you have violated these Terms or any applicable law. Upon termination, your right to access the Platform ceases immediately.

You may delete your account at any time through your account settings. Upon account deletion, your profile will be removed from public visibility. For details on how your personal data is handled after account deletion, including your rights to data erasure under applicable privacy laws, please refer to our Privacy Policy.

8. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall first be submitted to good-faith mediation. If mediation is unsuccessful, the dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Wilmington, Delaware, or remotely at the claimant's election. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Datings-Online LLC.

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
